Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and RoofCom, operated by Michael Anthony Jacobs, located at 23567 Fenton St, Clinton Township, MI 48036, Macomb County, Michigan ("RoofCom," "we," "us," or "our"). By accessing or using our website at roofcom.net, requesting a quote, scheduling services, or enrolling in our SMS messaging program, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, please discontinue use of our website and services immediately.

2. Services Provided

RoofCom provides residential and commercial roofing services, including but not limited to roof installation, repair, inspection, maintenance, and related home improvement services in Macomb County, Michigan and surrounding areas.

All services are subject to a separate written estimate or service agreement. These Terms apply to your general use of our website and communications channels, including SMS messaging, and supplement (but do not replace) any signed service contract.

3. SMS / Text Messaging Terms (A2P)

IMPORTANT: By providing your mobile phone number and opting in to receive SMS messages from RoofCom, you expressly consent to receive autodialed or pre-programmed text messages from us. This section governs your participation in our Application-to-Person (A2P) SMS messaging program.

3.1 Types of SMS Messages

By opting in, you may receive the following categories of text messages:

  • Appointment Reminders: Confirmations, reminders, and scheduling updates for estimates or service appointments.
  • Job Updates: Real-time notifications about your roofing project, including crew arrival, project milestones, and job completion notices.
  • Marketing & Promotional Messages: Special offers, seasonal promotions, discounts, and general marketing communications from RoofCom.

3.2 How to Opt In

You may enroll in our SMS program through any of the following methods:

  • Submitting a web form on roofcom.net that includes an SMS opt-in checkbox or disclosure
  • Verbally consenting during a phone or in-person interaction, followed by written confirmation
  • Texting a designated keyword to our SMS number as instructed in our marketing materials

By opting in, you represent that you are the account holder or authorized user of the mobile number provided, and that you are 18 years of age or older.

3.3 How to Opt Out

You may withdraw your consent to receive SMS messages at any time by:

  • Replying STOP to any SMS message from RoofCom
  • Emailing us at mike@roofcom.net with your name and mobile number
  • Calling us at (586) 894-2164 during business hours

After opting out, you will receive one final confirmation message. No further marketing or promotional SMS messages will be sent. You may still receive transactional messages (such as a final job completion notice) if you have an active service in progress, unless you request complete cessation of all messages.

3.4 Help

3.5 Message Frequency

Message frequency varies. You may receive up to several messages per week depending on your service activity and marketing preferences. We will not send excessive or unsolicited messages beyond what is reasonably necessary for the purposes described above.

3.6 Message & Data Rates

Standard message and data rates may apply to all SMS messages sent to and from RoofCom. These charges are determined by your mobile carrier and service plan. RoofCom is not responsible for any fees or charges assessed by your carrier in connection with SMS communications.

3.7 No Guarantee of Delivery

RoofCom does not guarantee the delivery of SMS messages. Delivery may be affected by factors outside our control, including carrier network availability, device compatibility, and geographic coverage. Time-sensitive communications should be confirmed by phone if SMS delivery is uncertain.

3.8 No Third-Party Sharing of SMS Data

Your mobile phone number and SMS consent data will not be sold, rented, transferred, or shared with any third party for their own marketing or commercial purposes. SMS opt-in information is used exclusively by RoofCom to communicate with you directly.

3.9 TCPA Compliance

RoofCom's SMS program operates in full compliance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and all applicable Federal Communications Commission (FCC) regulations. Marketing messages are sent only to individuals who have provided prior express written consent. We maintain records of all opt-in and opt-out requests.

4. Use of Our Website

You agree to use roofcom.net only for lawful purposes and in a manner that does not infringe the rights of others. You agree not to:

  • Use the website in any way that violates applicable local, state, national, or international laws
  • Transmit unsolicited commercial communications (spam)
  • Attempt to gain unauthorized access to any part of the website or its related systems
  • Introduce viruses, malware, or other harmful code
  • Collect or harvest any personally identifiable information from the website without authorization

5. Quotes, Estimates & Service Agreements

Any quote or estimate provided by RoofCom — whether via our website, phone, email, or SMS — is non-binding until confirmed in writing through a signed service agreement or contract. Prices are subject to change based on site conditions, material costs, and scope changes discovered during the project. RoofCom reserves the right to decline any service request at its sole discretion.

6. Payments & Billing

Payment terms will be outlined in your individual service agreement. Late payments may be subject to applicable fees as stated in your service agreement. In the event of non-payment, RoofCom reserves the right to pursue all available legal remedies, including the filing of a contractor's lien under Michigan law.

7. Warranties & Workmanship

Any warranty on labor or materials provided by RoofCom will be outlined in your individual service agreement. Warranties are non-transferable unless expressly stated in writing. Manufacturer warranties on materials are subject to the terms and conditions of the respective manufacturer and are separate from any warranty provided by RoofCom.

8. Limitation of Liability

To the fullest extent permitted by applicable law, RoofCom, its owner, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, website, or SMS communications, even if advised of the possibility of such damages.

Our total liability to you for any claim arising under these Terms shall not exceed the total amount paid by you to RoofCom for the specific service giving rise to the claim in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless RoofCom and its owner, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or related to your violation of these Terms, your misuse of our website or SMS program, or your provision of false or inaccurate information.

10. Intellectual Property

All content on roofcom.net — including text, graphics, logos, images, and software — is the property of RoofCom or its content licensors and is protected by applicable U.S. copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on our website without our prior written permission.

11. Privacy

Your use of our services and website is also governed by our Privacy Policy, available at roofcom.net/privacy-policy. The Privacy Policy is incorporated into these Terms by reference. By agreeing to these Terms, you also agree to the terms of our Privacy Policy.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Macomb County, Michigan.

You agree to attempt to resolve any dispute informally by contacting RoofCom first at mike@roofcom.net before initiating any formal legal proceedings.

13. Changes to These Terms

RoofCom reserves the right to modify these Terms at any time. When changes are made, we will update the Effective Date at the top of this document. Your continued use of our website, services, or SMS program following any changes constitutes your acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any signed service agreement, constitute the entire agreement between you and RoofCom regarding your use of our website, services, and SMS communications, and supersede all prior agreements and understandings, whether written or oral, relating to the same subject matter.
